1. Definitions
In these Terms and Conditions:
- "Holloway" / "we" / "us" means the property rental advisory service operating as Holloway, based at 19 Wualai Road, Tambon Hai Ya, Mueang, Chiang Mai 50100, Thailand.
- "User" / "you" means any person who contacts, engages with, or uses Holloway's services.
- "Services" means the Artisan Quarter Rentals, Deliberate Home Search, and Craft of Tenancy Support services described on our website.
- "Agreement" means the engagement of a service, confirmed in writing or by payment.
- "Website" means the Holloway website at https://hollowesas.
2. Acceptance of terms
By using our website or engaging our services, you confirm that you are aged 18 or over, have the legal capacity to enter into this agreement, and agree to be bound by these terms. If you do not agree, please do not use our services.
3. Service description
Holloway provides property rental advisory services in the Chiang Mai area, Thailand. Our services include:
- Artisan Quarter Rentals: Short-stay furnished properties (1–3 months) in selected Chiang Mai neighbourhoods.
- Deliberate Home Search: A one-time consultative service for tenants seeking long-term rental homes (6 months or more).
- Craft of Tenancy Support: A monthly retainer providing bilingual tenancy assistance and coordination.
Service availability is subject to property availability and operational capacity. We will communicate availability clearly at the time of enquiry.
4. User responsibilities
When using our services, you agree to:
- Provide accurate and complete information in all communications with us
- Not misrepresent your identity, financial position, or rental intentions
- Treat all Holloway staff with respect in all communications
- Use the information and guidance provided solely for lawful purposes
- Comply with Thai law and any applicable lease obligations
5. Prohibited activities
You may not use our services to:
- Engage in fraudulent or deceptive conduct
- Obtain a property under false pretences
- Sub-let or commercially exploit any property arranged through Holloway without landlord consent
- Harass, intimidate, or otherwise harm landlords, other tenants, or Holloway staff
6. Payment terms
Fees for Holloway's services are as follows:
- Artisan Quarter Rentals: ฿8,500 per week (plus property-specific deposit and costs)
- Deliberate Home Search: ฿16,500 one-time fee, payable upon commencement of the search
- Craft of Tenancy Support: ฿3,400 per calendar month, payable monthly in advance
All fees are in Thai Baht (฿). Payment methods will be confirmed at the time of engagement. Property rental fees paid directly to landlords are separate from Holloway's service fees and governed by individual lease agreements.
7. Refund policy
For the Deliberate Home Search service: if Holloway is unable to present a reasonable shortlist of properties matching your stated requirements within 30 days of commencement, we will discuss a partial or full refund at our discretion.
For Craft of Tenancy Support: the service may be cancelled with one calendar month's written notice. Monthly fees already paid are non-refundable.
Short-stay rental fees are subject to the cancellation terms of the specific property, which will be communicated to you before booking.
8. Intellectual property
All content on the Holloway website — including text, layout, and design — is owned by or licensed to Holloway. You may not reproduce, redistribute, or use this content for commercial purposes without written permission.
9. Disclaimers
Holloway acts as a rental advisory and support service. We are not a party to lease agreements between tenants and landlords. We do not take responsibility for:
- The condition of properties after a tenancy commences
- Disputes between landlord and tenant that arise independently of our involvement
- Changes in property availability outside our control
Advice and guidance provided by Holloway reflects our experience and local knowledge, but does not constitute legal advice. For legal matters, please consult a qualified Thai legal practitioner.
10. Limitation of liability
To the fullest extent permitted by Thai law, Holloway's liability to you in connection with any service shall not exceed the total fees paid by you to Holloway for that specific service. We are not liable for indirect, consequential, or punitive damages arising from use of our services.
11. Indemnification
You agree to indemnify Holloway against any claims, damages, or costs arising from your breach of these terms or your conduct in connection with a property obtained through our services.
12. Termination
Either party may terminate a service engagement by written notice. Termination does not affect any amounts already owed. In cases of serious breach of these terms, Holloway may terminate immediately without refund.
13. Governing law and disputes
These terms are governed by the laws of Thailand. Any disputes shall be subject to the jurisdiction of the courts in Chiang Mai. In the first instance, we ask that any complaints be raised with us directly at legal@hollowesas so that we can attempt an informal resolution.
14. Changes to these terms
We may revise these terms from time to time. Updated terms will be posted on our website with a revised effective date. Continuing to use our services after changes take effect constitutes acceptance.
